What happened
Phathom Pharmaceuticals, Inc. (NASDAQ: PHAT) said BDR Pharmaceuticals International Pvt. Ltd. filed suit against the FDA and related Federal Defendants on October 23, 2026. The case was filed in the United States District Court for the District of Columbia. It challenges FDA's refusal to receive an abbreviated new drug application referencing Phathom's NDA for VOQUEZNA. BDR says FDA wrongly used the GAIN Act to extend Phathom's NCE exclusivity for VOQUEZNA, or vonoprazan fumarate, tablets.
Phathom said FDA carefully and correctly handled the issue in its June 6, 2025 grant of Phathom's December 11, 2024 Citizen Petition. FDA recognized 10 years of NCE exclusivity for VOQUEZNA tablets through May 3, 2032. Phathom said it is reviewing the BDR filings.

Why it matters
VOQUEZNA can build value only if exclusivity and launch execution last long enough to support the branded franchise. This filing helps and hurts that view at the same time. It shows Phathom defending the exclusivity period, but it also keeps the regulatory risk in place. The report date is still about 5 years 6 months before May 3, 2032, so the protection window is still important.
That makes the filing a direct read on the franchise runway, not a new operating update.
The dispute also affects when ANDAs can be received and possibly approved. The filing says BDR may succeed in its challenge, which could shorten the exclusivity period and allow earlier ANDA review or approval. It also says the litigation, including appeals, may take a long time and be costly and distracting. The company says those developments could hurt VOQUEZNA sales, Phathom's business, and its prospects.
Earlier generic review would pressure the length of exclusivity and the timing of competition.

What's next
Phathom says it plans to take appropriate action to protect its statutory exclusivities. The next question is whether the court upholds FDA's recognition of 10 years of NCE exclusivity through May 3, 2032 or shortens it. A ruling that keeps the end date in place would support the case. A ruling that narrows exclusivity would weaken it. May 3, 2032 is the key date to watch.
